Overview:

The Bike Fort Collins 2020 Raffle is being conducted by The Friends of the Fort Collins Bicycle Program, Inc., dba Bike Fort Collins (“BFC”), a 501(c)(3) Colorado nonprofit corporation and tax-exempt entity. Net proceeds* from the Raffle will be directed towards BFC’s ongoing bicycle advocacy and bicycle education activities. Bike Fort Collins has established Official Raffle Rules governing the administration of the Raffle, the awarding of prizes, and participation in the Raffle. Any person who buys or holds a Raffle entry/ticket (an “Entry Buyer” or “Entry Holder”) agrees to follow and be bound by BFC’s Raffle Rules and BFC’s interpretation and application of them. All of BFC’s and its Games Manager’s rulings relative to interpretation or application of the Rules are final. The Prize Drawings and Grand Prize Drawing for the Raffle will take place on October 9, 2020 at 12:00 p.m. (the “Drawing Date”). The final entry purchase deadline for entries is October 8, 2020 at 11:59 p.m. (the “Entry Purchase Deadline”).

*Net Proceeds are defined as the gross proceeds from entries/tickets sales received by BFC less the payment required to secure any/all prizes (whether or not claimed or awarded in the Raffle), as well as all other Raffle-related expenses as determined by BFC.

Raffle Entry/Ticket Cost Information:

Raffle entries can be purchased as follows:

  • 10 entries for $10
  • 30 entries for $25
  • 75 entries for $50
  • 200 entries for $100

Eligibility:

Eligible Entry Buyers must be U.S. residents (living in the United States) and at least 18 years old at the time of purchase and not be prohibited by Federal or Colorado state law from holding or purchasing an entry/ticket or participating in the Raffle. If a ticket is purchased by an Eligible Entry Buyer who gifts or assigns the entry/ticket to another person (“Entry Holder”), then that person must be a U.S. resident (living in the United States) and at least 18 years old at the time of purchase and not be prohibited by Federal or Colorado state law from holding or purchasing an entry/ticket or participating in the Raffle. BFC employees and members of their household, as well as BFC board members may not purchase or hold an entry/ticket and are not eligible to win a prize.

BFC reserves the right to require proof of the eligibility of an Entry Buyer at any time and to void any ticket sold to a person who does not meet the eligibility requirements or who is precluded by law from holding an entry/ticket or participating in the Raffle.

Only one eligible person may purchase entries. Thus, only one Entry Buyer can be the official purchaser of each entry/ticket. An Eligible Entry Buyer may gift or assign another eligible person to an entry/ticket by listing them on the entry/ticket as well (“Entry Holder”). If an entry/ticket does name more than one person on the ticket and that ticket is drawn as the winning entry, BFC will consider the first person named on the entry/ticket to be the winner. Subsequently, the associated prize will be awarded to that name/person. It will be up to the first person named on the ticket to split, share or divvy the prize. Following the awarding and release of the prize, BFC will have no other obligation or involvement relative to the prize, and no other named persons on the ticket may make claims for the prize.

Purchasing Entries/Tickets:

Raffle entries may be purchased by Eligible Entry Buyers online at www.bikefortcollins.rallyup.com/bfc2020raffle. The entry process requires Eligible Entry Buyers to provide their name, address, phone number, credit card number, credit card security code and expiration date, and such other information as BFC may require. Receipts for entries/tickets will be distributed and entry numbers will be assigned in the order that payment is received. All payments will be deposited into a separate and dedicated bank account upon receipt.

Unofficial receipts for entries/tickets that are purchased will be emailed to Entry Buyers. Hard copies of receipts or official entries/tickets will be available upon request. However, it is not required for an Entry Buyer or Entry Holder to physically possess a hard copy of the entry/ticket or receipt to win a prize. Entry Buyers and Entry Holders need not be present at a drawing on the Drawing Date to win. 

Each Entry Buyer will also receive a 1-year individual membership to Bike Fort Collins valued at $25.00 and includes the member benefits listed on BFC’s website. Limit one membership per Entry Buyer. Thus, a membership will only be awarded on the Entry Buyer’s first purchase any of the four levels of entries/tickets. Any subsequent purchases of entries/tickets will not include a membership.

All entry/ticket sales associated with this Raffle are final. BFC will only make refunds if somehow the online platform it is using (Rallyup.com)(“Raffle Website”) errantly enabled an Entry Buyer to purchase the entries after the purchase deadline. No other refunds will be permitted except at the discretion of BFC.

The purchase of entries/tickets is not tax deductible.

Odds of Winning:

The odds of winning one or more prizes will depend on the number of entries/tickets sold. There is no limit to the number of entries/tickets BFC will sell.

  • Prize 6 / Grand Prize: A Niner MCR 9 RDO gravel bike with a 4-star component build-out (with 2X up front) (Retail value: $5,900.00). 4-star build components subject to availability and may be substituted by Niner Bikes for equal/like components. Prizewinner will be able to select size (53 cm, 56 cm or 59 cm) and color (black or olive green).

Drawing Procedures:

For the drawing of all six (6) prizes, the Raffle Website being used to administer the Raffle, at the direction of BFC and its Games Manager, will draw at random and determine winning tickets under the supervision of BFC’s Games Manager.

At the discretion of BFC and subject to approval of the Colorado Secretary of State, BFC may extend or modify entry/ticket purchase deadlines and drawing dates, times, and locations. A list of Raffle winners will be posted on www.bikefortcollins.org/bfc2020raffle. The BFC Games Manager is the final authority in the event of any dispute relative to any of the prize drawings.

Raffle entries/tickets for prizes will be drawn first beginning with the lowest-valued prize (Prize 1) and ending with Prize 6/Grand Prize. After each prize drawing, the winning ticket will then be re-entered with all the other Raffle entries/tickets for subsequent prize drawings. The drawing event will conclude with the drawing of Prize 6, the Grand Prize.

Entrant and Prizewinner Rules:

BFC will make reasonable efforts to contact each prizewinner using the information that was provided on the winning entry form. The prizewinner will have 30 business days to contact BFC. If contact is not made within 30 business days after the first initial contact notifying the prizewinner of their winning, then BFC will attempt to give notice to the prizewinner via U.S. Certified Mail, return receipt requested, at the address provided on the entry form. This notice will indicate and detail the prize that was won, a telephone number of a contact person at BFC, how to claim the prize, as well as stipulate that if the prize is not claimed within 30 days from the date of the notice, that BFC may, at its option, retain the prize.

BFC will not award or release a prize if the prizewinner did not meet any of the eligibility requirements stated in these Rules, or if the prizewinner provided materially false or misleading information to BFC in connection with the purchase of a raffle entry/ticket. If this happens, no other Raffle entry/ticket will be substituted and BFC will retain the prize. An Entry Buyer/Holder cannot assign or transfer his/her interest in a Raffle entry/ticket or a prize won by a winning Raffle entry/ticket.

As a condition to being eligible to take possession of the prize, each prizewinner will be required to: (1) sign a sworn affidavit of eligibility under these Rules and satisfactory prove that he/she is the person named on the winning entry/ticket, (2) provide proof that the purchaser of the entry/ticket was an Eligible Entry Buyer at the time of purchase, and (3) provide proof of identification and address that he/she is the individual claiming the prize. If any prizewinner fails to meet or comply with these conditions of taking possession, BFC may, at its option, not award the prize to such entry/ticket holder and retain the prize.

Each Entry Buyer and/or Entry Holder agrees their name, likeness or voice may be recorded by audio, video, or digital means and may be used in any print, audio or visual media without notice or compensation for any purpose including related to this or any other BFC Raffle or promotional materials, including future Raffles.

All Entry Buyers and Entry Holders release and agree to indemnify, defend, protect, and hold harmless BFC, its directors, officers, employees, agents and representatives (and any of their officers, directors, shareholders, employees, agents, advertising agencies, contractors, insurers, attorneys, accountants, and affiliated entities from and against all losses, damages, rights, claims, and actions of any kind arising in connection with, or as a result of, this Raffle and/or their failure to win or redeem any prize, or their award of, acceptance of, or use of any prize, or their failure to comply with any laws governing use any prize; and represent and warrant to BFC that they have read and understand these Rules and agree to be bound by these Rules, BFC’s decisions and/or BFC’s Games Manager’s decisions, which are final.

Raffle Conducted in Accordance with the Colorado State Law:

The Colorado Secretary of State is the regulatory authority with jurisdiction over charitable gaming. If and to the extent the Secretary of State expressly deems a specific dispute between BFC and person purchasing or holding an entry/ticket outside of the Secretary’s authority, BFC and that person agree that if there is a dispute of any kind regarding the award of a prize or the conduct of the Raffle, BFC and all persons purchasing or holding an entry/ticket agree to arbitrate such dispute. Such dispute shall be decided by binding arbitration in accordance with the rules of the American Arbitration Association then in effect and shall be governed by the United States Arbitration Act (9 U.S.C. §§ 1-16). By the purchase of an entry/ticket, all persons purchasing or holding an entry/ticket submit themselves to the jurisdiction of said court and appoint the then Clerk, or acting Clerk, of said court as their Agent for the service of all process in connection with such proceedings and consent to the arbitration of disputes between them.

This Raffle is being conducted pursuant to Bingo-Raffles License #2020-15458 issued to Friends of the Fort Collins Bicycle Program, Inc. (d.b.a. Bike Fort Collins), by the Colorado Secretary of State’s Office, and is being conducted in accordance with the applicable provisions of the Colorado Constitution (Section 2 of Article XVIII), Colorado’s Bingo and Raffles Law (Colorado Revised Statutes, Title 12, Article 9, Sections 101 to 301), and Colorado’s Rules Covering and Regulating Bingo/Raffles (8 CCR 1505-2).

The Raffle is subject to these Rules, the laws of the State of Colorado, and Applicable Law. If there is a conflict between these Rules and Colorado state law, Colorado state law shall govern. BFC reserves the right to modify the Rules and/or impose additional conditions, procedures, and requirements as may be necessary or required for the Raffle and the award of prizes hereunder to comply with Colorado state law. This Raffle is void where prohibited by law.
